An emergent meeting of the Executive Committee of the Sindh High Court Bar Association was held with its President Mr. Abrar Hasan in the Chair. The following resolution was passed.
RESOLUTION
Resolved that in the considered opinion of this Association, the President of Pakistan is not constitutionally authorized to suspend the Chief Justice of Pakistan. Further the allegations leveled against the Chief Justice of Pakistan are malafide and motivated.
Judiciary, Executive and Legislature being the three organs of the State derive their sovereignty from the Constitution. In fact the judiciary has an edge, over the Executive and legislature. Therefore, such an action taken by dint of force against the head of judiciary is not only illegal immoral un-constitutional but also uncivilized. This step taken against the head of judiciary in Pakistan is simply abhorring and will lower down the prestige of our country in the comity of nations.
It is further resolved that such steps are calculated to some how postpone the holding of general elections in Pakistan, which will not be allowed by the people of Pakistan.
The Managing Committee of Sindh High Court Bar Association in its emergent meeting held on 10th March, 2007 unanimously decided that its members will abstain from attending the Court work on 12th March, 2007. It was further resolved that the President and Honorary Secretary will immediately contact the other Bar Associations, Bar Council and Members of the Pakistan Bar Council available in Karachi and will hold a meeting on 13th March, 2007 at 11:00 A.M. to discuss the issue for Chalking out further course of action.
